6. AVAILABILITY OF PRODUCTS

The complete management of your order is subject to the availability of the requested products. Therefore, if when preparing your order in our warehouse the product you want is not available, or if there is no stock of said product, or if we consider that the product is not in a condition to be sold, we will inform you of this situation and refund the amount that you paid for said product within a maximum period of seven days as of the moment we inform you that the product cannot be delivered.

In any case, we will inform you of any modification that may occur to your order due to the unavailability of products.

The products that are offered through this web page are only available for shipping to the Peninsula, the Balearic Islands, Europe, and the rest of the world.

 

7. DELIVERY

Products that are available and in stock will be delivered to the user, after receiving payment for the order, within a period of up to 7 days in peninsular territory; up to 10 days on the islands; up to 12 days in the rest of Europe; and up to 15 days for the rest of the world.

The order will be sent to the delivery address indicated in the order form.

We do not make deliveries on Saturdays or Sundays.

For the purposes of these Conditions, “delivery” will be understood to have occurred when reception of said delivery at the agreed delivery address is confirmed.

 

8. PRICES AND PAYMENT CONDITIONS

The price of the product will be that which is stipulated on our web page each time. The price and other conditions of the articles that you have requested from us will obviously not be modified during the period of time between the offer and its acceptance emitted through the shipping confirmation, unless we must make retroactive changes to said policies, Conditions, or Declaration of privacy due to the law or governmental agency decision. Payment may only be made through:

9. RIGHT TO CANCELLATION

You have the right to cancel this contract without any justification within a maximum period of 14 calendar days.

Consequences of cancellation

We will return all the payments received from you, including the shipping costs of your order (with the exception of the additional costs that are the result of you choosing a delivery method that is different from the least expensive ordinary delivery method that we offer), if you should use your right to cancellation.

The period of time for us to process this refund will be a maximum of 14 calendar days from the date when we are informed of your decision to cancel the contract.

We will proceed to process the refund using the same payment method used by you for the initial purchase unless you expressly state otherwise; in any case, you will not incur any costs as a consequence of the refund.

We may withhold the refund until after having received the goods or until you have presented proof or return of said goods, depending on which condition occurs first.

The right of cancellation will not be applicable to contracts that refer to the supply of sealed goods that cannot be returned due to health protection and hygiene reasons, and that have been unsealed after delivery. Furthermore, CDs or DVDs that been unsealed by the user may not be returned.

 

10. EXCHANGES AND RETURNS

The following conditions relating to the exchange and return of our products are not applicable if the right of cancellation has been exercised. If for any reason you are not satisfied with your order, you have a period of 30 days from the date of delivery of your product to proceed with its exchange or return.

EL ARSA will assume the cost of replacing the product and the shipping costs if any of the products acquired by the User arrive damaged

The reference date for the period of thirty days will be the date indicated in the delivery document.

For any exchange or return, the product must not have been used and must be returned in perfect condition, including all labels, instructions, and guarantees (if any).

The return of the amounts paid will take place within a maximum period of 30 days measured from the moment when the order is returned, and to the same payment method with which the purchase was paid unless you choose a different payment method.

We will refund the amount of the product to your PayPal account if you paid for your order through your PayPal account and returned the product to our warehouse.

 

11. LIABILITY AND GUARANTEES FOR OUR PRODUCTS

The legal guarantee of all our products is that which is defined by law, and its terms will always be respected by L’AGRICOLA REGIONAL, SA.

Said guarantees are regulated by the consolidated Text of the General Law for the Protection of Consumers and Users which establishes that the minimum guaranteed period of time of any new article will be 2 years, albeit, after the first six months it is the client who must prove that the problem that the article presents is a manufacturing fault and not wear and tear caused by the usual and correct use of the product.

That said, assuming that the object under guarantee effectively does not meet the optimum conditions to be used, EL AGRICOLA REGIONAL, SA will assume the corresponding responsibility with the client and we will proceed to return the amounts paid for this product as well as the costs that the client had to pay to acquire the product. Therefore, the client may return the article to any of our stores, or post it to our warehouse, if said article has a blemish or defect, or if there has been a mistake with the shipping. Once the defect has been verified, we will refund the total value of the amount paid, including shipping and return expenses, and, as the case may be, the amount the client paid for gift wrapping.

We only refund the return costs when:

1) The article is defective.

2) A shipping error has occurred.

3) The article does not correspond to the photograph on the web page.

4) The order arrived after the deadlines indicated in our General Purchase Conditions.

5) The package was damaged during transport.

 

12. OUR right to change THESE CONDITIONS

13. APPLICABLE LEGISLATION AND JURISDICTION
